BMG Music Service Scam Every few years someone in my family gets a CD in the mail along with a bill... tied into a conrtact to purshase a CDs each month in exchange for some inital free ones. I think this is a scam perpetuated by a company that needs this to stay profitable. No phone # on their billing or web site... you can't call them.
You can't e-mail them either... no e-mail address or way to contact except through snail mail. You might think to just send them the $24.76 and be done with it but in doing so you create an appearance that there is a legitimate business relationship and they you will get tied in for the whole contract and much more expense. Ignore them then according to Fair Credit Reporting and Collections Acts... after 30 days pass and no rebuttal they can assume the debt is true and just and collect it.
Damned if you do... damned if you don't. My first inclination was to open the box (no markings). Happen to you?
What would you do? I don't want to be their victim. Asked by JayD 49 months ago Similar questions: BMG Music Service Scam Business.
Its a Gift According to Postal Service regulations, any time you receive anything in the mail that you never ordered, its to be considered a gift even if there's a bill in there. You owe nothing - not a red cent. I get free crap in the mail all the time and the bill that accompanies it goes into the shredder and I never hear a thing.
Why? Because I never ordered the item and I have no contract with the outfit, so I enjoy whatever it is they sent me - unfortunately, no one ever sends me a cd! I have never been billed for a thing and have an extremely high credit rating, so I know they aren't turning it over to anyone for collection - no way are they permitted to do that - I didn't order it.
If, on the other hand, you belong to one of those clubs where you have to send in a card rejecting that month's offer, then you're on the hook for that amount. But, if you never ordered it and aren't tied into the outfit in any way, its a gift and you can keep it, use it for a frisbee, target practice, whatever turns you on. So, enjoy it and don't worry about it.
Of course, your other alternative is to just mark it "Refused, Return To Sender" and after you do that 9-10 times, maybe they'll get the picture that you don't want their stuff. Several things to do. Return the bill marked Not Interested. I believe you are allowed to keep the CD since it was sent without request.
Return the disk and bill. Fight them when they mark your credit. I've not hit this.
I did try to do a contract with them once, but I never received my disks, just the bills for them. I finally called the number on the bill and canceled. Good luck..
No, it has never happened to me. Every time I join the BMG or CH clubs, I do it intentionally. It's possible someone is doing this in your name to get back at you for something.
If you're getting mail, just send it back to them explaining the circumstances and return the merchandise.
Just "return" ... I don't see why you can't simply return the item marked as "Return to Sender - Not Subscribing" and have done with it. I've done this for a few magazines or whatever in the past. Come to think of it I should do so on a few things right now.
Otherwise if you don't want to get too involved, just ignore them since you hadn't placed an order in the first place. I'm not a pro but that's my take.
Similar situation happened to me. Only it wasn't CD's, it was books. I opened the box, saw the books and said, no thanks.
But the mail won't take it now since the box was opened. You have to pay to ship it back. You eventually end up paying, one way or another.
Now, I don't open anything. If I'm not expecting anything and I get a package, it's Return to Sender, I don't care what it was.
