Can a person paying child support claim the child on his/hers taxes?

It depends on what was set forth in court. I divorced in 2009. I am sole caregiver for our child.

Our child resides with me 90% of the year. My "X" pays child support. It was determined by the court that we claim our child as a 'dependent' in alternating years (me-2009, X-2010, me-2011, etc.).

Some courts will grant the caregiver (the person who has the child residing with them over 50% of the year) the allowance to claim the child as a 'dependent' yearly until child support is no longer paid. The person paying child support is allowed to 'claim' the child support yearly. Hopefully any and all matters regarding the child in question were handled legally through the court system.

I'm not a tax expert and every situation is different depending on what state you live in and what was agreed upon with the court system, so i'd advise speaking with a CPA. I'm just relaying my situation with regards to the matter. Good luck!
