I doubt anyone except an expert from the company that makes the item that has been copied would be able to tell! By the way we take a similar eBay item from Hong Kong item with us (to weigh luggage on return journeys) and have never been stopped as it is always in our hold luggage not carry-on.
The simple answer to your question is yes, customs are law enforcement institution with authority to confiscate, impose penalty, etc and one of their jobs is to go after counterfeit products. That said it's extremely unlikely they will go after your little balance, they simply cannot inspect every single package.
They can, but they won't unless there is some big alert. They mostly take things that are over the duty free allowance, duty not paid, or illegal . They are not going to look and verify one pair of shoes.

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
