Can I receive money from my childs father if he is receiving ssi and disability?

Yes dependents that have parents that draw ssi and disability are entitled to draw off of them. Are SSI disability dependant benefits paid to the custodial parent (A) for child support, on behalf of a disabled divorced spouse (B), considered part of spouse (B)''s income? Spouse (B)''s SSA-1099 only states $23,022 in income.

There is NO mention of payments made to custodial parent (A). Spouse (B) has never been informed or notified by the Social Security Administration of the amount of money being paid to custodial parent (A). Question #2:Is spouse (B) obligated to report SSI disability dependant benefits paid to the custodial parent (A) for child support, as income in a financial affidavit?

SSI, also known as supplemental security income, is NOT taxable to the recipient. If the benefits are payable to Spouse B, but are directly being sent to Spouse A, (which I assume is the case since Spouse B receives the 1099), this does not change the answer, since child support is not taxable to the recipient.2. I am not sure what type of financial affidavit you are filling out, but your SSI benefits are considered income, even if paid to another party on your behalf.

This would be similar to you working and making $500 per week, with $100 garnished and given for child support. You only receive $400, but your income is still $500. However, you need to review the directions for whatever form you are filling out, as the SSI should not be included if the form is looking for taxable income, or what IRS considers "gross income".

I am wondering the same thing about my step children, who lives with me and their father. Their mother OD on meth and had a stroke, and now she is partially paralyzed on the left side. Court ordered her $50 child support because she is claiming she only gets $400 a month.

I think she is claiming the kids as living with her. How would my fiance' find out if she is, and also, someone told me that my fiance' (the childrens custodial parent) can just go to SS office and apply for his children to get benefits off her disability. She just moved into her own place, real nice apts, she drives, the children are 3,5,7 and 9 and shes been chasing after them every other weekend and then some for the past two years.

I say she can work, she walks with a limp but I have seen way more disabled people working at McDonalds and Wal-Mart, etc etc. Oh, and she still does meth and parties. I just don't agree with her living for free, free from all responsibilities and not being held accountable for anything--her (my) 4 children, and lets not forget the 5th kid she has with a different father that is 10 and she has dumped off on everyone his whole life. She makes me sick.

I just think its bullt she pays $50 a month (and acts like that kills her--taking away from her drug and booze money) for FOUR KIDS. And me and my fiance are sitting here struggling. So, anyway, I wanna know how my fiance can find out if shes getting money for the kids, or if he can just go to the SS office and apply for the kids to get a check off her disability? Also, how do we report that she is way able to work and that she is getting high again?

.

Yeah, and before she OD, she wasnt even around for the first year me and my fiance were together--the baby was just an infant. AND NOW she claims she wants to be a parent---they are nothing but meal tickets---shes scum .

If a parent’s only income is SSI, that parent cannot be forced to pay child support. Parents who get SSI cannot be forced to pay child support. Parents who get SSD might be ordered to pay child support.

Sometimes the SSD can count as the child support payment. Some courts may still enter a child support order, but will not enforce that order. Generally, however, a court should not enter a child support order against a parent whose only income is SSI.

The Child Support Guidelines specifically say that SSI is not counted as income on the child support worksheet. By definition, someone who is getting SSI is unable to work because to be eligible for SSI you must be unable to work Sources: http://www.indianajustice.org/Data/DocumentLibrary/Documents/1062265714.96/view_article_publicweb?topic_id=1380100 .

Someone help me figure out how to find out if he is drawing money off of us, that we know nothing about.

1 If you have an order from the court for child support - yes. You can get money from his checks. If he is ordered to pay child support, it doesn't matter what his source of income is - and SSI and disability is considered income.

I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
