Can my long-term disability company lay claim to my dependents social security benefits as repayment?

My company's long-term disability company paid me 60% of my salary for 2 years. Once I was approved for social security benefits, I received a retro check for myself and also for my 2 children.My disability company is now claiming that I have to pay them back since social security sent me a retro check. Now, I agree that I should send them my retro check, but NOT my childrens'.

Now, the policy states that they can go after any payments my DEPENDENTS' receive, but someone said that that wasn't legal, not for social security benefits. Does anyone know the answer? My disability company DID NOT pay me anything for my children.

Based on what you're saying, they cannot go after your dependents. Your long-term disability check claims just you and not your children. Your retro check claims you and your 2 children.

Should you decide not to send any check to your long-term disability company, they can claim you for either the amount they paid you. They can claim only the portion of the retro check that pertains to you and not the portion of the retro check that is for your children. If the long-term disability company says they need payments for your dependents, you're going to need to talk to a lawyer.

It does state on the agreement that they can lay claim to any monies I receive for my dependents, but I didn't know of that "section", was NEVER advised by that section from the disability company and I DID NOT sign anything, it was an employer's contract that they provided us as a benefit. In briefly speaking w/an attorney, who referred me to a disability attorney, stated that just because it's in an agreement, does not make it legal, and if it is, it's known as something which I can't remember that does not make it enforceable.

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
