1) open carry for pistols is nationally restricted to those 21 years of age or older 2) Even though it was a pellet gun, it would be illegal for a 12 year old to own it by law 3) if someone under the age of 18 is playing with a pellet gun, an adult must be there to supervise, (which there was not) 4) All replica toy guns must have a special orange tip barrel to allow the police to know its a toy. The tip was removed to make it look more like a real gun which is illegal. At this point the replica gun must be considered a lethal weapon by default.
5) Open carry means a gun is carries in a manner in which it is not readily being used. (aka in a hustler or sluing around the back if its a long gun). The gun was in the persons hands and being pointed at other in a threatening manner 6) when police demanded that the weapon be dropped, he raised the gun instead and lethal defense measures were taken.
