The married man, in his late 40s, allegedly kissed and groped the girl (13) while giving her private guitar lessons. Dublin District Court heard the teacher had advertised his classes on a supermarket noticeboard and the girl had been taking weekly lessons for nearly two years before the alleged assault. Cross-examined by the defendant's barrister, the alleged victim said the accused continued the assault as they moved on to another song, 'The Summer of '69'.
She was sitting on his couch playing the guitar throughout. Judge Aeneas McCarthy rejected defence arguments that there were too many inconsistencies in the prosecution case for it to proceed. He said the accused had a case to answer and adjourned it for the hearing of evidence for the defence.
