Perhaps I should explain a bit further. S first and second DWI's were within a couple of months of each other right after he started college. Fraternity specials, and almost 10 years old (almost) and 13 years from now.
S third was 3 years ago. He has had no tickets since then, none. He has done all court ordered bale provisions, including paying for a monthly blow device for these three years.
He is a responsible community citizen, home owner, church member and community activist, volunteering in many civic organizations. He did this before and after the DWI. He has two small children and a wife.
He went to court on the case and lost to an all woman 6 person jury. He has had many people write letters on his behalf, including clergy, sheriff's deputies, lawyers, and businessmen. But, I am his father, and need to write something special.

He deserved to lose it. If you're implying that he lost because you're in Louisiana, you're just wrong. In any case, if you're going to write the judge a letter, just say about your son what you said here.
I'm sure he's not a bad guy, but he's had his three strikes. In Colorado, he'd be in jail.
He will in La also. Come January 10. Mandatory jail time, but could get work release so his kids will still have a roof over their head. I'm not implying anything.

You're a dad, I understand. I still say just say what you said here. Tell the judge what a good guy he has become, and how at least he needs to have work release so that he can support his family.It's a hard lesson, and I'm sure he'll never do it again.
But you have to realize that (and being in Louisiana, I'm sure you understand), that three DWIs is a big deal.

Ask the judge if he would consider a court ordered rehab program, it's usually for 1 year. I know 2 young men, 1 is 18, the other 20 who were ordered to rehab for 1 year due to their DWI's. If they leave rehab early they go to jail for the rest of their original sentences, 5 years By the way, how old is your son?
Maybe you could make an appointment to see the judge ahead of the trial and explain your situation. Maybe you can get a settlement outside of court.
I understand that this is your child, and you love him, but come on. THREE DWI'S? He needs help, and going to jail might be a good place for him to admit he has a problem.

It doesn't really matter that he has children and a wife, that he belnogs to a church, owns a home, or anything else. He was driving drunk, and that is not what a responsible community citizen does. And the fact the you make it sound like it is the fault of an all woman jury does not sit well, with me.
If he did not drink and drive, putting every single person on the road in danger, then this entire conversation would not be taking place. I'm sorry. As I said before, I totally understand where you, as a parent, are coming from.
