We have been divorced for 2 years now. The house is in both of our names, she was ordered to refinance but was unable with her income.So, instead she filed chapter 13 to keep the house. I don't want the home and want my name and responsibility free of it.
I don't want my name on a home where my ex is living when we are divorced. I want to get a new home and start over. I filed Chapter 7 to free myself from the debt!

If you don't want your name on it, you should be able to remove yourself from the lease. I'm not sure about owning the house but I know you can with a rental. Call your Real Estate or other source to ask about that.
I had an ex that broke up with me and wanted me out of the house that I paid all the money for us to move into. So I went and removed myself from the lease and also shut off all of the utilities that were in my name. Hehehe.

Trust me I tried in vain to get my name offf the loan, but not possible, even in the court of law..The best I could get was having her to refinance and then remove my name..But, she instead filed chapter 13 to freeze the foreclosure action and is living for free in my our house and the collectors came after me because she had this freeze from the bankruptcy...So, I had to file and when I filed, I filed 7.
With 13 you repay and work out keeping the house and debt, with 7 it liquidates everything you owe and frees your name from the loan and deed. I am just wondering if in my filing 7 does that mean the bank can proceed with throwing her ass out on the street where she belongs? Falls 5 months ago .

The COURT ordered her by law to refinance the house we bought together in HER NAME only! She decided not to do that and FILED Chapter 13...... Which means it FREEZES any civil action I can file. When she filed 13 without (ME KNOWING)...The bank came after me for the loan that She was ordered to move into only her name.
Only when she filed Chapter 13 that froze any actions I can file against her. So, she is living in a house I am no longer living in ONLY I am paying for! So in order for me to move on with my life and stop paying for her to live in a home I am no longer living in I WAS forced to file...I don't know would you want the ex wife that cheated on you living a home your paying for ..And then files behind your back so she can live their free....Yeah I really had no choice....You really shouldn't pass judgement on someone like that.

T0mb0ygirlygurl missed the mark on this one. First, it's a loan, not a lease, but there is actually the same problem either way. Both a lease and a loan are agreements to pay someone money.
Asking to take your name off it is like asking, "Can I just blow off this obligation I accepted? " Of course the banks will not accept that. I have credit cards with debts on them.
Can I just "take my name off" them and forget about them? That would be silly. If I had to guess, I'd say they probably can't foreclose on the house while your wife is still in chapter 13, even if you filed chapter 7.
Oh trust me I know! I would think it would be easier, but it isn't. I didn't want the house after the divorce, but she did.
Which was fine with me! It was just impossible for the court to help me! I mean if she wants the home and wants to continue to pay for it after our divorce more power to her.

It's not the marriage contract you can't get out of, it's the mortgage contract. The bank agreed to help you get the house in the first place because you agreed to make payments in return. You can't just say "Psych!" and bail on your obligation (although, to some extent, filing bankruptcy is kind of like doing that).

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
