Yes, you can IF you had a lawyer handle the purchase & sale transaction for you. If you went on the cheap and failed to hire one, then you will have to sue the seller in order to get his garbage dug up and hauled away. However, you are going to have to have the work done first - you may find a lot more garbage than just tired, and when you have a receipt for the work, you can then sue him for the amount and your court costs.

Check your sellers disclosure to see if anything on it discusses this issue and see if the seller lied. If so you can sue the seller for the cost of the removal, other wise you are out of luck. Ironically this is something buyers look for when buying commercial property and hire special inspectors for it.
