YES - she should be! I just found out that here (NY) you can definitely get it. This was in court arguing over parts of my divorce, the judge asked my why I didn’t simply file for child support & maintenance (alimony) instead of a divorce... You bet she is......but your going to want to file for legal separation, that isn't the same divorce. Once you file there will be a hearing that sets child support, visitation, and any other issues that needs addressed. This is usually some what informal, well as informal as you'll get when dealing with legal matters.

Let's rephrase the question... The MOTHER isn’t entitled to child support, the CHILDREN are. In short, the custodial parent may be the one handling the money, but the support is for the child. And yes, both parents carry responsibility for financially supporting minor children.
