The tailgater is at fault. They should have left themselves room to stop in case of an emergency. The fact the person stopped suddenly is not the issue, and could likely never be proven they did it on purpose.
It's not illegal to stop suddenly, however it is to tailgate.
Unfortunately the tailgater is at fault even if the first car stopped on purpose. By law you have to be in control of your vehicle at all times, that includes giving enough room between you and the car in front of you. Its getting more common that someone pulls in front of you and stops suddenly so that you will hit them.
