The driver who stopped but didn't yield to the oncoming car. It's approach speed has nothing to do with it. You should have seen it coming and waited.
Not only is there failure to yield but also driving without due care and attention. You can't stand up in court and say I saw it coming but pulled out in front of it because I thought it was speeding.
I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
