Section 112 of the Estate Administration Act requires the executor or administrator to notify the Public Guardian and Trustee when a mentally disabled person is or may be a beneficiary under a Will; entitled on an intestacy or partial intestacy, or have a Wills Variation Act claim. Section 112 Notices are reviewed to ensure that the person's rights are protected. The notice will normally consist of copies of the documents to be submitted to the Court, and must be accompanied by the fee in the Public Guardian and Trustee Fees Regulation.
