The condo association should contact an attorney for advice. I would surely think the association would have the right to file a lien at the county court house. Then if the seller were to secure a buyer and the bank were to accept the contact the amount due the association would be paid or negotiated.
This is what I would think the procedure would be but who knows in this market.
Legal question - talk to a lawyer. If you have an appropriately recorded lien on the property, then you should recover the condo fees before a new buyer can have clear title.
I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
