Seller lied that car can pass smog check, it didn't?

First you register it as an off road vehicle and then you can do it. If you try and sell the vehicle as street legal, then the seller is responsible for the cost of the smog check passing.

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
