We are a publisher that has found that a seller on Amazon is selling fake copies of our books. What can we do? This seller is flipflop-books, aka Bargain_Deals.

They are shipping from South Carolina. We were notified of this by another publisher who had also been targeted by these people. When we ordered our book from them, we received a photocopied version of it that was obviously not distributed through our offices.

They even copied the cover with the same ISBN and our contact information. The return address seems phony. What can we do to make sure these people are stopped?

Send a complaint to amazon to have this issue investigated they will be more than willing to open up an investigation as to this. It may take time but this prevents fraudulent claims from being filed.

Step one is to take a deep cleansing breath. The problem is not really that they are selling your book, it is that you are not receiving your royalty. Unless you are really selling your book as a way of obtaining a customer list for cross-selling of a business opportunity or something, at which point the problem is you are not receiving your customer names.

Step two is to obtain a U.S. Copyright Registration for the book, if you do not already have one. Their website has all of the forms and instructions, and there are several books that help, or you can hire an intellectual property attorney to do it. The key is however you do it, do it ASAP.

Step three is to determine a fair royalty for sales of the book. Figure out what your production, sales, and distribution channels really cost, and ask yourself what you would pay to have all of that lifted from your shoulders. Remember, you are not losing credit for authorship, you are just letting the hard part of self-publishing be done by someone else.

Then make that offer to your new "publishing and distribution partner. " Since you ordered the book you know how to reach them. For a fair royalty and submission of the customer lists on a regular basis, and sufficiently high standards of publishing quality, and no editorial changes, they would have the right to sell the work and share the profits.

Once you are engaged in that discussion with your putative partner, you are learning about them.
