If the parents return to their native country with out being charged and there is no record of their illegal residency then the child may at a later date ask to have visas issued for the parents to re-enter the country. How the child will explain birth in the US without disclosing the parents illegal residency is an interesting problem.

The child goes with their parent back to their country, when they become an adult they can at that time claim their right to live and work where born. They are not being harmed if this was policy, because they were going to be born regardless whose dirt their parents were standing on, (or concrete). Far too many illegals are crossing just so they can have an american born child.
