Delaware Delaware was the first state to ratify the Constitution in 1787 giving it the claim to be the first state. Of course, there were NO states until New Hampshire (the required 9th state) ratified it in 1788 and it went into effect. So, technically, there were either 9 "first states" (those who had passed ratification up to New Hampshire) or 13 "first states" and they all came into being when the ratification was complete.
Eventually, all thirteen states ratified but it was New Hampshire's that was the one that counted.
