If youre married then he is legal, too. I don't get it. Frankly, anyone who drives illegally should be deported anyway, regardless of citizenship.
Mnwomen, he actually broke the law three times. Once for no license driving, once for coming back after deportation, and the first time was when he overstayed his right to be here in the first place (assuming he didn't hop the border illegally, the first time, that is). That is one count if unlicensed driving and two counts illegal immigration.
He now has broken the law twice. Once when he came back and the second for no license. What state you are in will determine his sentence.
If he gets jail he will do the time and odds are they will deport him after it is completed.
