A collection agency is threatening me about an accident with my car. I never had an accident, but they have all my info?

You may need a lawyer to find out what is going on. Or it could be a scam of some kind. They claim that they have a police report.

One way to check to see if there really is a police report. You may need to find out if the police really does have a police report. If they say that they don't have a report.

Then it must be a scam. If you had been in a accident it would show on your car. Is there anyone else that can get to your car keys and use the car.

If your car has no damage. Then take pictures of your car has proof that shows that your car is not damaged at all. I hope this helps.

Well that could be a problem, because I do have a slightly dented hood from an accident I had about 4 years ago. It was in Canada. The damage is not that bad so I never had it fixed.It's all rusted though.

The collection agency said this accident happened 6 months ago. I live in a pretty safe neighborhood and occasionally I have forgotten the keys in the car unlocked. But the car wasn't "stolen" It's still in my driveway...? What did they do, bring it right back?

It is all so weird. Other than that though there is no damage. Certainly no new damage but how can that be proven?

What happens if someone did take my car though (and return it as weird as that sounds)? What will happen? Also, there was and is no insurance on the car.

This has happened to my ex husband. He used his mother's car to go back and forth to work. One night he forgot the keys and the door was left open.(That was his fault for forgetting the keys) But what happened is I woke up to the sound of a car not to far from my bed room window.

I looked outside from the bedroom window and saw someone returning my mother in laws car. I could not believe my eyes. I could not make out who it was because it was night time.

The person got out and walked away from the car leaving the car door open. Of course I woke him up and he went outside. To our surprise.

And sure enough. The person returned the car with the keys still in the ignition. This could have happened to you since you mentioned that you have forgotten your keys a few times.

Someone took advantage of the car and they did put it back where it was. That's what happened in our case. I actually saw the person putting the car back.

Go to the police and talk with them about this. And see what can be done.

Ok I think that is what I am going to do. I am scared to go to them though. I admit I am kind of naive about these sort of things.

Can they arrest me? Obviously whomever "allegedly" had the accident didn't stay at the scene. The vehicle has writing all over it and it is very identifiable, so it would be easy to positively identify it if this IS the vehicle in the accident.

I am eager to see what the police report says but scared to talk to them about it in fear they can do something to me. I can prove I was at work on this day and didn't even USE this car. I'm just worried because the car has no insurance and didn't at the time of the accident either.

In order to clear this up. You may need to involve the police.

If you have proof that you were at work. Then that will work in your favor. At least that part can be proof of where you were on the day in question.

You need to immediately contact the police department and ask if there has actually been a report filed. I sounds very much to me like someone has taken the license number and VIN, and traced it to your name; and filed a false report; though the collection agency may be the one who is pulling the story. Hopefully you have taken at least a few notes - because the next step would be to file a report of fraud against the collections agency - which might, if there was a report filed, involve having the police inspect the car for the alleged damage.

She said she is sending the police report to me and I should have it in 5-7 business days. Should I wait and see what the report says? My car is still in my drive way and there is no visible damage besides a dented hood from when I DID get in accident but that was over 4 years ago and it was in Canada where I was living at the time.

Contact the police department, now. Tell them what has happened so far. If you have any paperwork from the previous accident, or can lay hands on some (insurance company records, maybe) then I would recommend getting ahold of those, as well.

Another dead end I guess. I ran into a ditch (i know...i know...) there was no other cars involved. I never even reported it since I was out of the country.

I am going to be honest, I'm scared to contact the police department. If there IS a police report...what are they going to do to me? Will they believe I had no idea of this accident?

I am only just now hearing of any of this. I have taken notes on what the lady told me earlier. That is all I have for now to take notes on.

The convo was short. She said I had an accident, I said I didnt, she said she'd send the police report and that she was persuing to suspend my license and registration. That was the end of the convo.

Worst case scenario will be that you will have to go to court. One thing that comes to mind: if the insurance is lapsed, is the registration also lapsed? Anything that can demonstrate that the car has spent the last year in the driveway will be a significant help.

A good insurance adjuster can also tell the difference between a dent from a ditch and a dent from a collision. It sounds very much to me like a scare tactic; though the biggest question is whether it is someone trying to fraudulently extort money, or if someone has stolen your identity and gotten in an accident.

Right...I guess I will have to wait on more information and dig deep and see what is really going on here. The dent (to me) is CLEARLY very old. The registration is not lapsed, only the insurance.

I live in TN and from what I understand you are not legally required to hold insurance on a vehicle in order to keep it registered. Ironically, the tags are up for renewal this month. Going to court as a worse case scenario doesn't seem so bad.

That eases my mind a bit. If I can plead my case to a judge i'm not too worried. For crying out loud, I can prove I was at work that day.

I would think/hope that would be enough in itself. I was worried about criminal charges or a huge payout of a sum I can't afford for no insurance and damages. And possibly losing my license.

I've been a lawyer since the mid 1970s. In all that time, I've never, ever heard of a collection agency being involved with an auto claim. I smell a scam.

Demand to know the name of the injured party and then have a lawyer contact them. If they won't give you the name of the allegedly injured party, call your local police and talk to one of the detectives who deems with consumer frauds.

So I just got the police report from this accident. I have never been involved in an accidednt or legal trouble at all for that matter so I don't know much about it, but from what I can see it looks legit. The company,by the way is Wilber and Associates, i've read they are strictly a collections company but they are stating they are a lawfirm.

Can anyone clarify the truth in that? Anyway, the lady was VERY rude to me and actually hung up on me three times ( I kept calling her back....see how she likes harassing phone calls) she insisted that she CAN send my info to the state to recomend they suspend my license and that they will based on the evidence they have which is the police report. I asked her if there was PROOF my car was in this accident.

She said the police report is all they need, it is up to me to prove that it wasn't. So I then asked her again if she had proof that it WAS, did they have any kind of photo or video evidence? Because the proof that I have is the car is still in my driveway with no (new/recent) damage and proof that I was undoubtedly at my place of employment on that day with my other vehicle.

What I want to know, is CAN they truley suspend my license based soley on someone saying it was my car? They could have written down the wrong license plate for all I know. Just because there is a police report that this was the car in the accident is mere heresay from the other driver.

The police officer doesn't know for sure that it WAS my car either. He just did the report. What can really be done now?

You have some sleuthing to do because someone stole your identity and obtained the info on your car and used it instead of theirs to dodge liability. The trick will be finding the faceless bureaucrat who input the wrong information without verifying the source. How much time do you have?

From the information I have gathered so far, I really feel that the vehicle in question IS my vehicle. My vehicle is very identifiable and the collection agnecey lady knew about the specific physical details of my car. Whoever filed the police report has SEEN my car.

I am waiting on the actual police report to be sent. I will be contacting the police station as well to get the full report (if there really is one...which like I said, seems to be there is) I wasnt given any time frame or limit. She just said she'd send the police report and I'd get in in about 7 days but that didn't 'stop her from persuing to have the license and registration suspended' which I now know is not within her power until I've gone to court.

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
