Okay I understand what you are trying to convey. You are trying to say that if a daughter claims her share in father's property, and her husband too will claim his right on his father's property, then daughter will get double advantage, i.e. Daughter got share from her father's property and also got share from her in-law's property through her husband.

But you need to understand one thing, that in earlier era girls used to have no right on parent's property, because traditionally it was assumed that girls leave parents' home and go to her husband's house, where her husband will take care of her lifetime and also girls were given dowry while getting married while son stays with parents and take care of them in old age so son was said to be the real heir of parent's property. But time has changed now. In order to discourage the evil system like dowry & to create equality between men and women & reduce sexism in society, the government brought such law that both sons and daughters will have equal rights on ancestor's property and also on father's property unless father prepare will and leave property on someone's else name.

And if father dies without leaving will then daughters too become legal heir of equal share in father's property. But you are concerned that daughter can get double advantage as she claims property from her father too and her husband too will claim from his own father's property, but remember what is legal is legal. Legally daughter has right on father's property, if she have a brothers and they have problem with it, then they too can ask their wives to claim property from their father to get double share, however its upto their wives to claim or not.

But one more thing, traditionally it was believed that only son has right over father's property it was because he stays with parents and take care of them. But today time has changed, laws has changed too and is favor of women, but some of mindset haven't changed. In earlier times, brothers give dowry to sisters and regularly give gifts like rakhi gifts etc. to sisters, her husband and her kids because it was believed that since she don't have any right over parent's property, atleast she should be given something in the form of dowry and gifts, but as per today's time, if daughters claim share in father's property, then no other gifts should be given to her in the form of customs and traditions and also she should be told that she will have to take equal responsibility in taking care of old parents.

I am the only son and I stay with my wife and son at my fathers acquired house. My sister got separated and she stays with us from last 6 years along with her daughter. My father died this year, not sure if the house is freehold or not.

Now how will it get divided, do I have a share in that or that is my mother s sole decision. My terms with my father was not so good, but mother is fine. Sister had been always good with father, Not sure, if she can take everything as she is not good with us as well.
