There are, of course, no legitimate legal reasons for denying same-sex couples civil rights. All the ones I've seen here are based on religious ones or what people imagine other couples do in the privacy of their own bedroom. The threats to the "sanctity of marriage" come from within the heterosexual institution--divorce, infidelity, abuse, marriage "reality" shows, states that have no waiting period and/or residency requirements so couples can easily marry.
Denying same-sex couples the rights to fill out joint income tax forms, make medical decisions for their spouses, inheritance rights, etc., do nothing to protect "traditional" marriage, which has changed many, many times since the institution was invented. A judge in California just ruled that there are no legal reasons whatsoever to deny same-sex couples the same rights as heterosexual couples with regard to marriage. Equal protection clause, folks.
Deal with it.
Point of order: "civil liberties" concern basic rights and freedoms guaranteed.......either thru being explicitly identified in the Bill of Rights and the Constitution, or interpreted through the years by courts and lawmakers. "civil rights" revolve around being free from unequal treatment based on certain protected characteristics (race, gender, disability) usually in settings such as employment and housing. It has already been determined (judicially) that the power to regulate marriage lies with the legislature, not with the judiciary... ANY change in social institutions must remain at the bidding of the people through the democratic process.
Before a court declares a new constitutional right of a fundamental nature, the asserted right must be 'objectively, deeply rooted in this nation’s history and tradition,' which same-sex marriage is not. Civil rights HAVE to be pursued under the state laws...
