I want to claim head of household, since it IS my house & my bills (boyfriend & his son just live there w/ me), but I need to claim a dependent. Can I claim the boyfriends son? Afraid not According to IRS publication 501, they have to be a relative. They can be a step-relative through marriage, but just living with you isn't good enough, even if you otherwise supported them. Example 4 in the publication describes exactly your situation, and says "no".

I keep finding 5 rules that say "if the person cannot claim anyone, they earn less than $3500, they live with you all year, they are US citizen & under 18" then you CAN claim them even if not related to you.

I just want to be sure. Also he is my boyfriends "adopted" son & his mother cannot claim him at all, so its not as if anyone else HAS to claim him.

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
