Yes and No... Generally speaking if you've been approved for SSD your children also can collect based on a preset percentage. You then need to get a court order that basiclly says the SSD your children receive is your child support. Generally SSD will be higher than the amount you were paying anyway.

SSI, NOPE.. Child supports stops. SS and SSDI, yes they can. IF you get disabled and cannot work.

Even while waiting on a judgement, you are still viable. When you get accepted, you recieve a lump sum from the months you were waiting, if you have children, they get 1/2 of your sum. So if you get 1500.. 2 children.

You will recieve 1500, and your children will recieve 750.. OR 375 EA, until they turn 18 and graduate HS. If you owe back CS, then you will be paying Arrerage, taken from your child support... From my understanding, the first 750, cannot be touched. But whatever left over after first 750 is taken, 15% can be utilized.

If that's the case, and I know it once was, then I don't see why your disability checks can't be garnished. There's a statutorily prescribed maximum percentage of take-home, or net, pay that can be deducted from the debtor's paycheck. Child support is a serious matter and I think the government is taking it more seriously than it once did.

Actually YES SSDI can be garnished but not SSI. I receive garnished payments, however if the childs dependent check is more than ordered child support then no it takes the place of the support, If it is less than the ordered amount I will be subtracted from that amount and the rest will be garnished and the arrears amount will be divided into monthly payments and will also be garnished. The lump sum payment one receives for back due ssdi cannot be garnished but the child also will get one.

Just imagine being a father and becoming disabled and waiting 3 years for disability pay and then you have gotten behind and then they finally pay you ,. And you get garnished....no they cant touch one red cent of that disability check thats why your dependant child gets money also you dimwits .

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
