Can my social security disability checks be garnished from a car reposession in ohio?

Can my social security disability checks be garnished from a car reposession in ohio I had a car repossessed about 9yrs ago. I had mechanical problems 2 days after I bought it. The car lot refused to take care of the problem.

They pretty much ripped me off. I wasn't going to pay for a car that I couldn't drive. I told them that so they came and repossessed it.

They resold the car then they tried to make me still pay for it. This is 9yrs later and they are sending letters to my fathers house wanting info on me to pay this car lot. Social Security Income is not subject to garnishment from debt collectors except in the most extreme circumstances. In those cases you can request to have Soc Sec. Checks mailed to you , if you are part of a direct deposit plan, so they cannot retrieve the funds from your account immediately.

Statue of limitations The statue of limitations is 5-7 years in most states. If it has been 9 years and you have not paid anything on the debt or acknowledged the debt in any way, they are barking up the wrong tree. What you're running into is an aggressive collection agency that buys bad debt and tries to harass people into paying something on the debt.

The collection agencies will tell you there's no statue of limitations on debt, or just make something up, but there is. This collection agency has bought the debt for pennies on the dollar, so they just use the law of averages. If 5 out of 100 people pay something, the agency makes money.

Ignore the letters. Toss them out. If they call your father, have him tell them he doesn't know where you are and to stop calling him.

They cannot collect on this debt as long as you do not acknowledge it and do not pay anything! .

1 Well, first, there is no such thing as social security liability. You either get S S income, or S S disability. And yes, it can be garnished.

4 The answer is still yes. You should never had told them to just come and get the car. What you should have done was cite the "lemon law" and forced the car lot to take care of this situation.

Now, here's the deal with them selling the car. When they sold the car, they most likely did not get what you owed on it, and you are legally responsible for repaying the rest. Example: you owed 2000.

The car sold for 800. You owe the remaining 1200. Sorry, but that's the law.

You need to contact whoever is wanting the money (collection agency? ) and se eif you can work out something. If it is a bank, they can and will garnish your income - regardless of where it comes from.

If it is a collection agency, they will ruin your credit forever. Best to try to work out some sort of payment plan. This is a debt you owe.

5 No it cannot be except by the IRS for Taxes...In all other instances it is exempt from attachment. Google this and learn! They may attempt going after your checking account: If so, simply take that paperwork to Court ( It will not cost you anything to file), and the judge shall release the funds by Order back, and place an estopple order halting "anyone" from attaching it again: If the sole funds you deposit there are from your disability check ONLY.Blessings.......Annlee .

I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
