Can one owner of a car that the title reads "or" sell or trade it if the other owner is going to file bankruptcy soon. My husband is going to buy a new car and is going to trade the car that has both our names on the title as "or". I have hired a lawyer to file bankruptcy for my business.My husband is not filing bankruptcy.

Will this be considered fraud or what kind of problems will this cause if he trades this before the bankruptcy is started. When he buys a new car my name will not be on the title. Please let me know what to do.

You each own the car, totally and separately if it reads 'or'... If the title to the vehicle read 'AND', then you would both own it JOINTLY...and would both have to sign the title to sell it or trade it in..... but When the title is written with 'OR'...then either one of you can sell it or trade it in without the signature of the other. I'm certainly no lawyer, but, it would seem to me that...unless you have claimed that vehicle as a 'business expense' on your income taxes...and depreciated it over the years...then the car should not even be a consideration in your business bankruptcy case. And, too...the car is owned by you OR your husband, not with title in the name of the business... But, not knowing the details, I don't know if you are filing 'personal' bankruptcy' or if it ONLY the business... But, it should be OK for him to trade the car in.....as long as it's not an 'asset' of your business.

Depends It depends on the kind of business. If it's incorporated, a business bankruptcy will not affect your personal finances. If it's an individual proprietorship or partnership, then your personal finances are involved, and buying a new car will complicate things.
