These would be two separate crimes, even though the first one was in error. A crime is an entire event, such as "On this date, at this time, person A murdered person B by shooting him three times with a Glock 9mm pistol, which he legally owned." A second shooting on a different date would not be the same crime.
Consider this: If I punch you in the face and go to jail, does that mean that I can thereafter punch you in the face whenever I see you without risk? Of course not: Each time I do, it's a separate crime.
Its not double jeopardy because the person was not really killed and the conviction for the frame is void once you can show that the person is alive. Killing the person who set the frame is actually a separate crime.
