My current husband was slapped with a csc charge back in the days. He passed 2 lie detectors and the child that had the exam was passed by a doctor. Due to him at the time unable to read & write his court appointed attorney told him to just take a plea bargain in which he did because he didn't know any better.

He was young and dumb. However, We are trying to fight this. Trying to get his named cleared because he is now considered a sex offender.

Anyways, my question is. He currently is considered a sex offender until this is resolved. Can we still have children of our own and move on with life or would they be taken from us?

Could my ex husband that I have children with take our children from me as he has threated to? I am a stay home mom and I am with my children all day. Its not like I dump my kids on my husband.

Do my husband and I have any human rights? Or personal space? Asked by karebear23 44 months ago Similar questions: CSC human rights Politics & Law > Crime.

I used to be a police officer, and I know that, frankly, you have had your rights taken from you Your husband has little recourse. The likelihood of this being expunged from his record is rather low, no matter what the circumstances were. Child protective services and the courts treat Criminal sexual conduct cases like they are the most heinous crimes in the country, even when a fair percentage of them are 16 year old boys having sex with 15 year old girls that is consensual.(And a small number of Vice versas there).

CPS can come in, on almost any pretext and take the children from your former marriage into custody - all they need is a reasonable complaint (That is what precipitated the thing that just happened in Texas - no known crime, other than a different family structure, was committed. That could happen to you because of your husband's status. And I am sorry to tell you that your Ex will, if he has any sort of stability at all, likely be successful in gaining custody if he pursues it.As I said, the courts treat CSC offenders in a very cavalier manner.

And by association, you have entered that realm. I doubt they would take your (the two of yours) children, but it is highly possible as well. CPS prides itself on taking care of these CSC offenders, even if the case was nothing back then Sources: My advice .

Okay, tough one... So first, your ex-husband is a jerk. He has absolutely no right whatsoever to 'take' children that you and your current husband, boyfriend or lover have. If he's not the father, then his rights are non-existent.

Second, assuming that you are currently caring for children that you had with your ex, and you are also currently living with your current husband, I guess it's possible that he could go to court and seek custody of the children he fathered...but this is completely separate from you having children with your current husband. If you have cared fo the children for years without problems, and can show that your currwent husband's record is being contested, I think you have a very strong case to keep custody. Only if your ex-husband can show abuse of his own children does he stand a realistic chance to have them taken from you.

Third, your current husband appears to have gotten a pretty bad deal. He has grounds for appeal in that he didn't speak English, a translator wasn't supplied, and he passed the lie detector and the medical exam showed no damage to the child. Basically, he has a claim of inadequate counsel (ie: his lawyer really did a bad job).

Basically, you need both a civil lawyer (for the bogus charge against your current husband) and a family lawyer (regarding the kids). That could end up being pretty expensive, so I'd start off by trying for a pro-bono attorney (an attorney who works for free). Call the local Bar Association; I live in Denver, so for me it's simply "The Denver Bar Association" and ask for pro bono attorneys, and multi-lingual attorneys, as they are more likely to be sympathetic to your current husband's cause.

This is a difficult time, I'm sure, but I think you've got a good chance to have your husband's record corrected. And of course, you should be able to keep your children, regardless of your husbands threats. Sources: (I'm not a lawyer and this shouldn't be considered legal advice.) .

2 But Poppet, you know (your Hubby or your Dad, I can't recall which, is a PO) that CPS has most of the power regardless of the circumstances and length of time. I know one of the best men I have ever met. He works as a garbage collector, but is smarter than I am.

He reads, he has a nice family and kids, wonderful parents. But that's it on jobs for him - he has an english degree - but no one will hire him. Because he's a registered sex offender.Yep.

When he was 17, he had consensual sex with his 15 year old girlfriend. He's on a website, nasty people paint stuff on his house from time to time, he has to check in and if he moves, he has to live at least 1 mile from any school. Can you imagine how difficult that would be in most cities?

This is for life for the guy. A Lawyer (pro bono) tried to get it expunged 3 years ago (the guy is like 32 now).No. Woman after woman after woman, none of whom knew him or his "crime", were allowed to speak at his hearing.

A paid lawyer (he wants a 50,000 retainer and then hours) says he can get it expunged, but my friend doesn't have the money. Plus, he says it doesn't matter. Even if it IS expunged, he is on independent (of the Sex offender list) websites that will never be expunged..
