That will be up to the court appointed psychiatrist to determine, but I will say it is hard to believe that he isn't mentally ill. If he is declared mentally ill the conversation that needs to take place is how to change the law regarding mental illness and the dangers the current law poses to the public at large. It will be difficult to untangle, but I am sure it can be done.
If one knows a person with a mental illness it isn't difficult to detect. The problem lies in trying to get them to voluntarily seek treatment. Basically, they have the right to be mentally ill as long as they are not a danger to themselves or others.
Many mentally ill patients refuse treatment. And if they do seek treatment those records are kept under lock and key.
I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
