Of course he has rights, quite independent of his nationality or residency status. Paramount at the moment are his right to a fair trial, and his right not to be ill-treated while in custody. I hope that he gets both of those things, and (as a result of the trial) an honest verdict in accordance with the facts.

Regardless of U.S. citizenship status, anyone accused of committing a crime on U.S. soil IS given some degree of Civil Rights and Constitutional accordances, as fiercely mandated / protected by Federal law(s). The investigating officers assigned to Dzhokhar Tsarnaev's case are getting used to the new procedurals involving The Patriot Act; to be safe, they read Tsarnaev his Miranda rights. News reports are saying Dzhokhar Tsarnaev IS aware of his rights, the charges levied against him, their sentencing penalties IF found guilty and IS cooperating with investigators.
Legal analysts contend it may be a full year before Tsarnaev sees his court day; there's still plenty of investigating work ahead.
