I owe money on student loans but am unable to pay on them at this time because not working or going to school full time right now. I also got married in Feb 2010. If my husband files his tax return status as "married, filing seperately" can they seize his refund if he claims me an exemption?

I don't need to file a return as I had no income but afraid his refund will be seized if he claims me, or uses any of my medical expenses, etc. As deductions on his return. Also, can he file Head of Household? Asked by SLaMartinez 10 months ago Similar questions: owe money student loans unable pay time working school full Business > Financial Services.

File for a student load deferment. Your interest will accrue but your payments will be deferred for a couple of years. You can do this more than once.

I have, but even under 'Deferred' status, they still seize any tax refund(s) SLaMartinez 10 months ago .

Yes, I experienced it first-hand last year :( SLaMartinez 10 months ago .

Doesn't sound right to me. And you just answered your own question. Your answer is yes.

I was working last year, unmarried, and filed my own independent return. My question is with regard to my current situation. SLaMartinez 10 months ago .

I just don't understand this. I know a bit about deferred student loans and it doesn't work for me. Maybe things have changed a great deal in a short period of time.

Honestly, I was surprised when they intercepted my refund last year when the student loans were under 'Economic Deferment' status but they did so. I am not trying to get out of my responsibility to repay them by any means, I just need to be able to be economically viable in order to pay on them. Anyway, for now, just trying to get an informed answer before my husband files his return because we need to pay off bills with his refund.

No prob. I appreciate the attempt but I did learn that one firsthand! ;( SLaMartinez 10 months ago .

Your student loan being in DEFERMENT should not affect your tax refund; however. If you are in DEFAULT and you're not paying your loan as required than your refund may be withheld to pay your student loan.

You can probably get the answer from H & R BLOCK or one of the other tax services before you file.

You forgot to mention one of the most important criterion. This is a matter of state law. It depends where you live.

->In a community property state, generally, yes. ->In a separate property state, generally, no. divorce.lovetoknow.com/List_Community_Pr... is assuming your name is not associated with any of his financial matters.EG: Bank accounts, credit cards, mortgages, etc. He can file Head of Household if one of the following is met:1) Determine that you were not legally married as of December 31 of the tax year.2) As of December 31 of the tax year, you were legally separated under a separate maintenance order issued by a court.3) As of December 31 of the tax year, you had not lived with your spouse at any time during the last six months of the tax year.

As I am not a tax expert, please consult with one instead of guessing.Com/List_Community_Property_States.

And that "owe-money-one-can't-pay-because-of-not-working" is going to be happening more and more in this economy. Most likely those were government loans, so there's no defaulting or bankruptcy on them. You simply put up with collections calls and accumulating interest until you can pay them off.

I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
