No they're not. People are only entitled to work in this country if they are a citizen or have governmental authorization to work (since their working displaces a citizen's potentially working. ) The one staying over on an expired visa is a criminal hoping he doesn't get caught while he takes money and employment a citizen should have.
The IRS should be notified of his dodging tax laws and the INS should be notified of his employing people here illegally. Since "It's a New York State Tax dept issue," you go over the state and bring in the feds.

The fact that he's willing to break employment law should be an indicator of his scruples and should have been a sign that if it's not in writing, it doesn't count.

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
