My sister has just gone through a divorce and her ex will not pay the child support for the 4 kids they have together. She is thinking about going to ORS, and is wondering if they require a paternity test... More than likely..YES THEY WILL I have a sister and some friends that hae been through all this before and I do know for a fact if he denies being the father then YES they will request a DNA, therefore if he is not denying being the father then they should not cause there is no need for it, but honey if he owes it , make him pay. There are so many out there today getting away with it, it took me almost 5 yrs. To receive child suppot..hope this helps some..
Depends If the children were concieved during an "intact" marriage, then the husband is presumed the father, and if he is listed as the child's father on the birth certificate, then he should not be given the option to even ASK for a paternity test. (I'm in KS, might be different where you are) If he is contesting that he is the father, and he is NOT listed on the birth certificate, then yes, they would require a DNA test to confirm that they are his children. If it was stated in the divorce decree that he would pay "X" amount of child support and just ISN'T paying it, then she should contact her lawyer or the county clerk.
He is in violation of a legal court order and can be held accountable. They should also be able to process a request to have his wages garnished and he will be required to pay all "back child support" from the date of the seperation or date of divorce decree (whichever is stated in the legal paperwork). If they have already gone through their divorce and he did not contest the paternity of the children at that time, then he should not be able to now.
She should definitely contact her lawyer to help her with this if it continues. Sources: Personal Experience .
You didn't say what state they are in! And I would hope they do require a paternity test.
A paternity test is not required for the court to determine child support. Only if he contests the fact that he is the father would a test be required. He is in for some tough times ahead if he won't play by the rules.
I trust that there IS a child support order. Is that correct? If so, he is liable for payment from the date of the order until the children are emancipated. If he doesn't pay, they will report him to the IRS so any tax refund will go to the child support, he will have arrears accumulating on his account and will have to pay all that back support and generally be considered a deadbeat dad by that system (it also ends up on his credit report).
Enforcement of a child support order is different in each state, so some of this depends on where you live. Keep after the enforcement officer and ask them if there's a way to garnish wages or enforce the order some way that he cannot avoid his responsibility. I am a divorced dad and cannot imagine allowing my kids to go without things they need.In fact, their mom gets child support for them, but they get plenty more from me directly.
Whenever they need something they know I'll help out with money or buy it for them outright. That's how they get their laptops, cell phones, some clothes (designer stuff) etc that their mom considers "luxuries" that aren't in her budget. Deadbeat parents should be ashamed to bring kids into the world and then abandon them when their marriages go bad.
The kids have nothing to do with the issues between two adults and as much as possible, their problems should NEVER be financial because someone won't pay support. It just TICKS ME OFF!
I am guessing ORS is your local child support agency.. more info is helpful...
If he proves he is not the father he can sue for refund of any support paid plus interest and fees, and often that will affect any visitation and other issues with the divorce afterwards, as it shows infedility and brings up trust issues and honesty issues that the judge will weigh heavily. If she has any concerns she should get the test done, so that he does not have the chance to come back after her. Even if he is named on the Birth cert, if he is not the biological father he can then go after her....Hope this helps.

I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
