After my wife had a three month affair with her boss, she and I had a conversation in our kitchen where she admitted having the affair. She was unaware that I was secretly recording her admission. I later played the tape for family to hear.

She is now telling me that is a felony. Is that true? Asked by Dataevalnut 33 months ago Similar questions: crime tape conversation spouse knowledge play family Politics & Law > Law.

Yes. It is a crime. You didn’t say what state... if you tell me what state you are in but assuming you are in Las Vegas, NV as your profile shows... Nevada is not like Virginia (where I live).

Virginia is a single party consent state. You can record a conversation without the other party (your spouse) knowing if you are a party to the conversation. That means that you have to say something... to take part in the conversation.38 states allow this.12 other states (including yours... Nevada) require the consent of ALL parties to the conversation. So to record your spouse you would have had to get his consent by starting out on the recording saying, "Is it okay if I record the conversation we are about to have?

" Ridiculous I know. It is illegal everywhere to record a conversation you are not party to ANYWHERE in USA... it is called "bugging", "wire tapping", etc... stiff penalties. I would recommend you just toss the recording and hope she forgets you did it... can't use it in court or anything.

1 It is against the law to tape a conversation without letting the other person know they are being recorded. You are not going to be able to use this against her for any reason in court, and she could press charges against you. It is just plain tacky and extremely childish to play it for family.

2 Depends on what state you live in. Some states allow people to record their own conversations without disclosure, others don't. Check with your State Attorney General's office or look for the info on your state's website.

Either way, it's a nasty thing to do. Was your wife confessing as the start of the reconciliation process or as the start of the separation process. Let me tell you from experience that being vindictive like this isn't going to make your continued marriage (or impending divorce) go any more in your favor.

You're bound to end up in an even uglier situation. You're hurt. I know.

Get past it and move on with (or without) your spouse but don't live in the muck and mire of getting even. Life is too short.

3 If you taped it in person, you are totally within your rights. If you taped a phone conversation, you're supposed to advise the other person. In some states.

Recently, a conversation I had with my spouse reminded me of an album...

If you had a conversation with someone and they responded with a derogatory remark about your spouse/mate...

I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
