No, it is not legal. Your boss is required, by law, to give you a 1/2 hour lunch and two 15 minute breaks for every 8 hours worked. He doesn't have to pay you for the lunch, but does have to pay for the breaks.
I suggest you very quietly contact the wage and labor board in your county and report him.
According to the United States Department of Labor: "Federal law does not require lunch or coffee breaks. However, when employers do offer short breaks (usually lasting about 5 to 20 minutes), federal law considers the breaks as compensable work hours that would be included in the sum of hours worked during the work week and considered in determining if overtime was worked. Unauthorized extensions of authorized work breaks need not be counted as hours worked when the employer has expressly and unambiguously communicated to the employee that the authorized break may only last for a specific length of time, that any extension of the break is contrary to the employer's rules, and any extension of the break will be punished.
Bona fide meal periods (typically lasting at least 30 minutes), serve a different purpose than coffee or snack breaks and, thus, are not work time and are not compensable. " .
I agree with Turbo too. I worked for a company that occasionally did stuff like that. But as long as I was into overtime by Tuesday, I didn't care too much because the rest of the week was at time-and-a-half.
My job is supposed to be 'part time' and I didn't want 40 hours to begin with. I've never had a job that has done that. I just started this job and I don't even know when pay day is.
I've always been told to take at least a 30 min lunch whether I actually was going to eat or not, plus I would get two, 15 min breaks. Miss1973 14 months ago .
OK. You gave a little more info. You're in Texas, so the law is:"Texas state laws do not specifically address the issue of breaks during the workday.
The lack of explicit laws generally leaves to the employer the question of what policy to implement regarding breaks. Federal laws, which apply in the absence of state laws, likewise do not mandate breaks, but do set standards for breaks if the employer offers them. "Texas labor laws make workday breaks--whether brief rest periods or longer meal periods--optional and at the discretion of the employer.
Employers theoretically may require employees to work any number of consecutive hours without designating a break period, as long as employees receive compensation for all time they work. If employers allow breaks, they may stipulate all conditions such as length and frequency. Labor unions may negotiate the right to breaks in collective bargaining agreements on behalf of member employees."The federal Fair Labor Standards Act imposes certain guidelines relating to compensation during workday breaks if the employer offers them.
If the break period is no longer than 20 minutes, employees must receive pay for their time during the break. If the break is a full meal period of at least 30 minutes, the employer does not have to compensate employees. If employees have to stay on-site and perform work duties during the meal period, however, they must receive pay for their time.
