They (obviously) don't want the truck because They would only have to find a way to get rid of it and have decided it is not financially viable for them to do that. Some may tell you to sell the truck without a title but that is not only illegal, it would leave you liable for any accident the truck may be involved in later. Some salvage yards may buy the truck from you for parts or for scrap without demanding the title?
If you go that route, make damn sure that they don't turn around and sell the truck because if they do, you would again be liable. Have you asked your bankruptcy lawyer for advice? Maybe he could write a letter to or call the lender on your behalf?
After all, He did get collect a fee for services, didn't he?. Seems to me that he is the one who should be helping you.
The BK attorney should be your source of information. The BK attorney might write a letter to the lien holder giving them an option to either take the truck or release the title (those are the only two options I can see). Since the BK has been discharged, the debt no longer exists.
Most state BK laws allow you to keep a vehicle so that you'll have transportation. The lien holder is getting free storage of the vehicle. I think the lender really was the con artist on this one.
Loaning $27,000 on a vehicle worth $15,900. They probably made enough money on the interest that they've recouped the value of the vehicle. But I would really be surprised if you did get a clear title to the truck.
I would continue to drive the truck as if you owned it (license and registration and insured). Then if and when they repossess the truck, you cancel the above. It is not a stolen truck, so don't worry about it.
I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
