My LL is trying to evict me for complaining about Mold Problem that has caused my family health probs. Need Legal Help?

Well, the problem is if you notify your housing authority that you have mold, they'll tell you to move out too. If your landlord wants to let you go, then find another place to live so your family won't be sick! .

Of course we are definetly moving out. We already found another place and are planning on moving next week. But the problem is, we want him to pay for his negligence, and fraudulantly renting us the place knowing of the problem.

He admitted to us that he had painted over the problem before, and the photos show that he had this prblem before, but failed to fix the problem properly, and risked my family's health. And he shouldnt get away with this. We are getting medically checked in a few days.

But research shows that infections due to mold are sometimes permanently? So there should be something that we can do? And besides all this, we want to fight the eviction, and don't want it on our record despite the fact that we are moving out next week.

Well, if you can prove actual damages, such as extra medical costs, etc. , you can sue him for that in small claims court. If your lawyer wants to take it higher and sue for pain and suffering, etc, that will be up to him and your family. Make sure you take lots of pictures.

Otherwise, just get out of there and don't look back.

Waiting on the court date to be set. Getting ourselves medically checked out on thursday. And am only bumping into two problems, one is I cant seem to get a lawyer who would help represent us, or at least make sure we have all are proper information set for trial?

And Secondly I cant find a Certified Mold Tech. I live here in South Texas, and there are hardly any available. And as for the lawyers, it feels as though they are agitated with the word "MOLD"?

I feel as though we have to have a ton of money to pay for a good lawyer, or someone in my family has to die in order to get good representation? As though our Health is not good enough? It seems as though we are going to have to fight this on our own?

Ed McMahon had this problem and illustrated how big a problem it is. He sued the people responsible and that lawsuit was years in court. Meanwhile, he was spending his (considerable) wealth on finding somewhere else to live.

Locally, we have a frozen yogurt shop that has been very successful. They found (after some years in that location) that there was mold. The landlord, who lives in China, had a negative interest in spending his money to fix the problem.

They moved. I've not heard how any lawsuit on that one went, but another yogurt shop has replaced it. This is by way of saying that the one who OWNS the mold is usually disinclined to fix the problem because fixing a mold problem is expensive.

You can sue the person; that's your right. If you have evidence of prior knowledge, that will well-argue in your favor. Only, expect the lawsuit to be 5-10 years wending it's way thru the courts.Be happy this isn't India.

You make complete sense. I do in fact have evidence in one of the photos that I have attached below that shows that he had tried to repaint over the Mold damage prior to us moving in. Plus he even told us personally when we first complained about the problem that he had admitted to painting over it.It is very obvious in the photo.

He had even sent over a plumber to see if there was a leak (which there was in the ceiling at the time) but it had stopped by the time the plumber came to see. The fact of the matter is, we don't mind how long this would take, its not really about the money since it is taking place in small claims court. Its about him not getting away with it.

I agree with DanZee. Do you have a Legal Aid Society where you live or a Housing Authority? .

I just emailed the Local Legal Aid office this afternoon. And sent them my complaint and photos, and just hoping that they will respond with some good news? As for the housing authority, do they take these type of complaints?

I thought there were there for people who are under housing? I actually tried calling several county offices last week, and they all gave me the run around, and all said that they do not take care of these type of matters. It was very frustrating, and felt that noone wanted to help or get involved?

I would think the housing authority would be able to help. I have read where they help where other problems were involved. What about a State consumer agency?

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
