Please note I am not a trained lawyer in international law. A question like this would be suitable to be explained by an expert in this field. What ever is written would be from articles which I would have read and data collected from these articles.
Also judging from what I have read this is a very complex situation and would need a considerable amount of time to fully understand the pros and cons of the crux of the matter. Please read the links listed below these links will provide you with plethora of information on the questions asked. opiniojuris.org/2010/06/02/why-is-israel... alertnet.org/thenews/newsdesk/LDE6511I7.htm ejiltalk.org/legal-issues-raised-by-isra... Russia condemns Israel actions calling the blockage a violation of International law.
How do you perceive this statement? This statement by Russia probably have some validity. I must say that not only Russia is stating that it is violation, other countries have also stated that the blockade is in violation of International law.
On the other hand this could be an opportunity for Russia to voice their opinion on the issue and cause the international community to pressure Israel to lift the blockade. US says Israels actions are legal according to international law. According to these articles Israel have enforced the "San Remo Manual on International Law Applicable to Armed Conflicts at Sea".
Also one must take into note the "law of blockade which was derived from customary international law and codified in the 1909 Declaration of London". The 1909 Declaration Concerning the Laws of Naval War allow a country or a state to legally blockade an enemy in a time of war. According to Kevin Jon Heller in the article "Why Is Israel’s Blockade of Gaza Legal?" if the conflict between Hamas and Israel is an international armed conflict (IAC), Israel have all right to enforce the blockade.
The US will back Israel when it comes to matters dealing with Palestine. The United States is considered Israel greatest ally Russia says Israels actions are a violation of international law. Reasons why Israel may be violating international law would be it cannot be enforcing an non-international armed conflict (NIAC) or international armed conflict (IAC) due to the fact it is not currently occupying Gaza which is not recognized as a state.
How do these two statements affect Israel ability to act? Personally I do not see the two statements having an affect on Israel. Israel will continue to do what is necessary to protect its country and citizens from any attacks internal or external.
And the main reason for this is the fact America is its biggest ally.
I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
