First of all, do you have any insurance, i.e. Comprehensive or 3rd party insurance? Note: when I say 3rd party insurance I'm not talking about the COMPULSORY THIRD PARTY (or CTP green slip in NSW) which covers personal damages you mentioned, I'm talking about covering damage caused by your car to property/vehicle owned by a third party.
If you have any of the those insurance, then just tell your insurance company and they will deal with it. You'll just have to pay the excess for the claim. How much they want for the damages it's your insurance company's problem (and since the primary goal of their business is to minimize payouts they'll do everything they can with their high priced lawyers), and you won't need to worry.
If you don't have any insurance, well that's pretty silly especially if you cant afford comprehensive, 3rd party is very cheap. Anyway, DO NOT write the letter to say you're willing to pay but don't have money because you would have just admitted in writing that YOU ARE WRONG AND WILLING TO PAY. Write a letter mentioning these points: -You acknowledge that you are at fault for the accident.
-You have evidence/photographs of the actual damages caused. -The cost of car hire is not your legal responsibility nor did you agree/authorise to pay for it or has it been brought to your attention or discussed beforehand. If I'd crash my corolla, takes 1 days to repair, I go hire a mercedes for 5 days and the bill says "car hire", it's hearsay and all nonsense and would not hold up in court.
And being a fleet vehicle, they would have insurance, which would cover hire car. In most fleet insurance, a hire car is issued by the insurance company from their designated hirer and at the very most you will only pay a small percentage of the hire rates. -Ask them to adjust the bill for the repairs accordingly and if they have given you a bill from the mechanic, point out which repairs are unjustified.
If not, ask them for a copy of the bill from the mechanic and make you have the contact details of the mechanic. -Tell them you are willing to settle the matter in court if the cost of repairs are unjustified. -Sign and date the letter by hand and make a photocopy -Don't send any copies of the photos you have.
If they continue to tell you to pay for the $1600, then file a civil suit against them and you will win for sure (you'll still have to pay for actual damages though). Since you have sent them a letter regarding the situation and trying to resolve it, they cannot counterclaim for any legal fees. So the worst that can happen is pay $1600 and ~$100 for court fee.
It's a massive hassle but good luck! And get some insurance in the future and all this can go away by paying a few hundred dollar excess. Think about it, what if you crashed and totaled someone's $100,000 car and you have no insurance?
Shiva's rite write the letter and let it go to court you have the pics to show what damage was done by you they r taking the p sorry but they r.
I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
