It depends on the type of lawsuit. If it is a personal injury suit, such as a auto accident. Or a creditor vs. debtor suit.In the latter one, the defendent has the option of state and/or Federal exemptions to protect property both real and personal.

A personal injury suit(tort), is a completely different matter.
