Actually, the question is no less legitimate with an intoxicated man and woman. The only reason this example is any more compelling is that the irrelevant distraction of claims that a man being sober enough to achieve an erection must be sober enough to be aroused is avoided. The response in literature on this issue among those who take the view that intoxication constitutes inability to consent and therefore rape is that while mutual rape is counter-intuitive, it is not in fact a reductio ad absurdum.

It demonstrates that many cases that do constitute rape would nevertheless be impossible to prosecute - especially mutual rape - but that doesn't change the ethical point. EDIT In response to the poster below: I actually tend to agree that it constitutes a reductio. I was presenting the responses from the literature as I best recall them.

(I haven't had the patience to dig out references but the position has been defended in a few articles.) I don't actually subscribe to this view and the mutual rape scenario is one reason for that. Whether or not it constitutes a reductio, a result so counter-intuitive renders the whole analysis suspect and if one is not primarily concerned with the legal question, I wonder if the purpose is more propagandistic. (Actually, that depends on the person defending the analysis.).

It doesn't really matter if its two women, two men, a man and a woman, what it comes down to- even if both are equally intoxicated, is who was the aggressor, and did anyone say NO at any time... Those are the things that really matter in a rape case, unless you live in a "stone age" state that believes someone cannot be raped by someone of their same sex.

No and it is time for Congress to know women are using the law to get revenge on men.

It's not about two drunk adults. It's about a drunk female and sober males. I wouldn't have sex with a drunk woman knowing the consequence.

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
