Smokers do have a legal right to smoke. Cigarettes are legal. You were misinformed.
And, I don't really understand what you are saying. You refer to your porch, and your patio, then you call them shared areas. They cannot be both yours and shared at the same time.
Government passed no smoking laws inside public areas. Note - inside and public. The businesses have to allow people to smoke outside.
There are no laws saying people cannot smoke outside. Your home and porch is not a public building. I would suggest baking a plate of cookies and going next door to meet your neighbors, and nicely explain your son has medical issues, and ask them if they could maybe move away from him to smoke.
But, since you are calling them rude and ignorant, clearly you are not willing to try to be nice. Bottom line is this. People can legally smoke outside.

Yes they can be shared areas - there is an open iron railing about 2 1/2 feet high in between them. But the roof is over both porches and the main steps lead up to both again there is a railing in between but the end sides are enclosed I wish I could draw you a picture. It would be easier to explain.
But they are not allowed onto my side of the prch since there is a railing to separate it. They have their side and I have mine but yet its all connected - see? And I looked into it - just because ciggarettes are legal does not mean that smoking them is covered under the constitution.
It is not. And again there are no condo bylaws here - that is why I am petitioning our local council to enact an ordinance for it. They have laws about everything else including what time I am allowed to put my garbage out, but I own my home and can't protect my son because of thse people?

They woman is pregnant so obviously she doesn't care about her own unborn child, why would she care about me or mine? It may be a public area but it is a shared common area of both properties. If I want to paint the steps I have to get their landlords permission since the steps are used by both of us to gain access to our homes.

I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
