My brother has 4 kids from his one and only marriage and has gotten behind $30k in payments to them. He now has 2 other children in his custody and the girlfriend has pretty much written them off. Any time he gets a good legitimate job they attach his wages and he only brings home 25% which isn't enough to pay rent or anything.
What rights does my brother have since he is now the sole supporter of his youngest 2 children? He is currently sleeping on my couch and can't even get a foothold due to his situation.(s ex-wife has now remarried if that effects anything...) He needs to go back to court e needs to go back to court about the child support. It can be reviewed and also he can agree to a payment plan and that will allow him to get more of his check to take care of his little kids but also ALL his kids! As he needs to take care of all of them still, after all he is there dad!
Otherwise look at Bankrupcy. Not sure how that might help, but its worth looking into. Atleast that way the past owed could be structured so he can still get $$ to live and support his other kids on.
I assume he has called his ex-wife and talked to her about workign it out and she is not supportive of the idea. Maybe a threat that He will be asking HERT for spousal support will get he attention and make her listen. Hope this helps.

It would depend. It would depend on specific state laws, which I am not in a position to explain. He needs to see an attorney, specifically an attorney, that is sympathetic to your borther's situation.
They will have to appear before a judge to get payment ruling changed. Only a judge can change the payments. I doubt that anything can be done about the $30,000 owed in back payments.
But then that is where the attorney comes in. Child support is child support& is not based on the marital status of the former wife. If alimony is awarded, that is based on marital status.
I wish him luck.
He is screwed. He can go back before the judge and try to get the order modified, but that's not likely to happen. Unfortunately, courts only consider the existing obligations by date order.
If your brother's financial condition has changed, and his ex-wife's has too, a judge could modify the order. However, (and this depends on state statutes) the amount in arrears plus the current amount generally can be set at 50% of your brothers income until he is caught up. Now, then, the other part of this equation.
Your brother has only himself to blame for getting 30k in arrears; he's obviously been a deadbeat dad for a while to accrue that much in arrears. Additionally, he should know that if his income changes, or his ex's changes, he should be infront of the judge requesting a modification. Your Brother is responsible for all those children. Not to be mean or anything but until those children are 18 he is responsible to take care of all the children he has fathered. That is why it is so important to get some education and control those desires.
He could have at least worn a condom or used another form of birth control. He placed himself in this situation and now it is up to him to get himself out of it. I had a number of children myself and faced almost the same problems but I stuck with it and paid as much as I could for all those years and now I am clear of it.
And I married a woman that had two boys and their father NEVER paid anything. He was a mechanic and got paid under the table and never claimed any income. These kind of fathers are dead beats and need to be jailed and held responsible until that debt is paid in full..
1 Your brother is the father of 4 children. He has a responsibility to pay child support to the 2 children he has from a prior marriage. It doesn't matter in the least if his ex-wife has remarried.
He's the father and he should provide for ALL his children. If he doesn't feel a sense of responsibility to his children from his former marriage, maybe he should give up his rights to the children and have the stepfather adopt them. That is if the stepfather wants to adopt the children.
Although, that won't make a bit of difference with the back child support he owes. I can't understand why you would consider the 2 children from the prior marriage as his "previous family. " They ARE his family.
As for the topic you've listed, "justice," if there were truly justice in this case your brother would be arrested as a deadbeat dad. I'm sorry if that is rude, but I think this whole situation is despicable.

I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
