Mortgage escrow problem You did not specify whether you recently closed on a new mortgage, or if doing the normal course of loan servicing your mortgage company paid your taxes twice in error. If you recently closed on a loan either as a new aquisition or refinance, find out who made the remittance mistake. It could be that on your HUD1 settlement statement the settlement agent made a remittance for the tax payment and shortly thereafter your servicer duplicated the payment in error.
If you recently refinanced -the servicer of the original loan might have made a remittance, and shortly thereafter the settlement company or servicer of your new loan might have duplicated the payment. Find out from the taxing entity who made the remittance(s)and when the payments were made. Request a copy of the payment receipts as you should make your loan servicer aware of the duplication so that they can request a credit from the taxing entity to get the money back into your escrow account.
If it was paid in duplicity by your loan servicer in error - they should be held accountable to correct the error - if a phone call to the servicer does not clarify the error - request an "escrow analysis" from them which should confirm the duplication. Seek legal council regarding your bankruptcy question as I believe in most situations you probably can salvage your primary residence during a bankruptcy, however I also believe there are situations where it might not be possible. I cant really gove you an answer,but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest.
