Individuals don't really get to decide to "press charges." You can report suspected illegal activity to the police (or Child Protective Services) and let them investigate. If you don't report illegal activity at the time it occurs, doing so later appears highly suspicious, and like you're trying to retaliate for something else.
It indeed looks like that's what you're trying to do here. Ultimately, this is your brother's legal issue. You need to let him deal with it.
If she's trying to take legal action, stop doing anything to justify her claims of harassment and to justify a restraining order.
