I wouldn't argue the case. I don't have any proof. If it ever went to court the judge would throw the case out.
I would talk with the garage owner and let them know what happened. They may or may not fix it. I would have to accept and live with their decision.
If they fixed it, I would give them a lot of free publicity with my friends. If they didn't I would also pass that information along. Just in case you end up having to fix the scratch your self, I have included this link that explains how: How to repair a scratch link: infobarrel.com/How_to_Fix_a_Scratch_on_Y... Disclaimer: I have not tried this!

I would bring it up (kindly) to the person who runs the garage and ask to have it fixed. Explain to them that my car was just in for a repair and when I arrived home, I noticed the scratch. The worse they could do is deny it or make excuses ("The car is old" or "It looks pretty banged up the way it is") and I would have to pay to get it fixed or do it myself.
I do not think it is worth arguing over, especially if my car IS beat up. I think it would be smart to reassure the garage that all I want is the scratch to be repaired and that I am not asking for free parts, repairs, inspections, full paint jobs or things of that nature (some people will try anything!). The garage will hopefully understand that I'm not trying to scam them for random free services and will gladly fix it at no expense to me (hopefully).
If not, can't say I didn't try. The garage might fix it regardless for fear of losing one customer and possibly others if word gets out that they are sloppy.
If you donot have any evidences to prove it was done by others in garage, you could do nothing except feeling annoyed at home. Or you could ask the car insurance company, or drink a bottle of cool water.
I certainly would talk with the manager or the tech who repaired my car, if they damaged it they would pay with out a doubt.
I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
