First of all, let me just say that at my current workplace, the thought of my boss getting mad at people drinking is pretty much impossible to imagine. We had a white elephant exchange a few days ago, and I'm pretty sure he brought a bottle. It was the first to get stolen.So the answer's yes.
It's a glass of champagne; it's hardly binge drinking. And the potential social repercussions of not joining in (peer pressure, yes, but office politics is all about peer pressure) far outweigh whatever a boss would think about an adult having a glass at a coworker's party.
Not me, I'd have to live with my own conscience. I am pretty much a stickler for rules and doing the right thing.

Having a drink with dinner is customary, so why wouldn't you want to have one at an office birthday party? If there is only one bottle for everyone, no one is going to get intoxicated anyway. Why not have a glass, enjoy it, then get the rules changed the next day?
