I am breaking a lease to leave an apartment early, but have already paid my rent through the month of October?

I am breaking a lease to leave an apartment early, but have already paid my rent through the month of October..... Our reality company is asking us to leave as soon as possible because they found new tenants who want to move in ASAP. They are not forcing us to move early, just requesting that we do. However- If I have paid for the entire month and leave early, won't they owe us the money back for the days we were not living there?

The law or reality Since you are breaking the lease, I doubt that they HAVE to pay you back for the entire time you have left on the month. They should pay you back for the time the new tennents have paid for (they are not allowed to collect rent twice for the same apartment. However, if you find a place to go you can go into the office and ask them if they will pay you back for the time left that you have paid for.

I bet that they will. If they won't, I would still leave as soon as possible. Since you are breaking a lease, you are responsible to pay until they find someone, even if it takes until the end of the lease period.

They only have to show an effort to lease the place (putting an ad in a small paper shows the attempt, but if it takes them 6 or 8 days to call back people who are interested, that is time you have to pay for). This is based on California law, the rules in your state may be different.

1 If you are breaking YOUR lease (a binding contract) and they are kindly requesting you leave early (so they can paint/clean/carpet clean) to re-rent and help you to NOT lose more money, why wouldn't you want to help yourself out?! Disclosure: I'm a property manager. Your question is asked of me all the time.

My response: Do you want to shoot yourself in the foot? Or give yourself a boost?

2 Sounds like you're in an excellent position to negotiate. That's what I'd do. Maybe not what a property manager would want to hear, but you can't lose anything by asking.

3 You are NOT in a negotiating position. Irritate the PM, then LOSE out on her/him re-renting your apartment. Your Landlord doesn't care if unit sits empty.

Just as long as there's a lease and it's being paid for. PM is doing you a favor by tring to rent apartment in a BAD economy at a BAD time of the year to re-rent (Fall/Winter are the SLOWEST real estate seasons). You have a binding contract.

You can be held liable for the rent until the end of your lease. Landlord can have rent docked from your pay check.

I cant really gove you an answer, but what I can give you is a way to a solution, that is you have to find the anglde that you relate to or peaks your interest. A good paper is one that people get drawn into because it reaches them ln some way.As for me WW11 to me, I think of the holocaust and the effect it had on the survivors, their families and those who stood by and did nothing until it was too late.
