Your husband's last name will also be the child's legal last name. You are still married; you are not divorced. Your husband's name will automatically appear on the birth certificate because, by law, he is considered to be the legal father.
It is not necessary that your husband be present at the birth, nor does he have to "sign any papers". In law, the man a woman is married to at the time of a baby's birth is legally the father of the child - the legal father does not have to be the biological father. In your situation, the name of the biological father of your child will be shown NO WHERE on the child's birth certificate.
